Divorce by publication is a legal procedure used when it is not possible to locate the spouse, even after conducting a diligent search. In these cases, the law allows the process to be served through official publication, provided the requirements established by the applicable state and court are strictly met. Our team guides the customer throughout this process to ensure that the documentation meets all legal requirements and that the petition can move forward correctly.

How Our Service Works

Pre-qualification

The process begins with a pre-qualification, which determines whether the customer meets the basic legal requirements to get divorced in their state, such as residency, type of divorce, and the existence of an agreement between the parties.

It is important to understand that the pre-qualification only confirms legal eligibility to file for divorce in the corresponding state; it does not automatically guarantee that the case will be accepted within our service.

Questionnaire

If the customer passes this stage, they are asked to complete a detailed Interview Questionnaire, organized into sections covering general information, marriage data, personal information, spouse information, assets, debts, and children where applicable.

Document Verification

Our legal team carefully reviews all information received to assess the complexity of the case and confirm that it falls within the limited scope of our services. If the case is eligible, we proceed with the personalized drafting of the documents. If it is not, the customer is informed and recommended to retain an attorney specializing in family law for direct representation.

Final Verification and Filing

Once the documents are prepared, the parties may review them before signing. Subsequently, notarization takes place — either through an online platform when the state permits, or before a local notary — and finally, our attorney conducts a final legal compliance verification before filing with the court.

Final Decision

Before sending the case to the court, the customer must pay the applicable finalization fee, which includes the court filing fees, via Zelle or Money Order. After filing, the only remaining step is to await the judge's decision.

Hearings and Legal Representation

In most states, uncontested divorces do not require a hearing.

However, in some states, such as Maryland and Texas, at least one hearing is mandatory. When possible, the customer may retain additional legal representation for appearances, if necessary.
