Residency Requirement and Competent Court

To file for divorce in New Jersey, the state residency requirement must be met in accordance with current law.

Eligibility depends on whether you or your spouse meet the residency requirements in the state:

If you or your spouse have resided in New Jersey for at least one (1) year before filing the petition, then you may file for divorce in New Jersey.

In this case, the divorce is generally filed in the corresponding court of the county where the Plaintiff resides or where the Defendant resides.

If neither you nor your spouse have met the one (1) year residency requirement, then you must wait until one of you meets this requirement before being able to file a divorce petition in New Jersey.

This requirement is mandatory and the court will not accept the case until the minimum residency period is met.

How Does the Process Work in New Jersey?

Pre-Qualification

The process begins with a pre-qualification to confirm that you meet the basic requirements, including the one-year residency requirement in New Jersey.

Document Verification

The Plaintiff reviews the documents first, after which the spouse reviews the documents. Once both spouses have confirmed, we request payment of the Initial Filing Fees ($314 for cases without minor children or $365 for cases with minor children) via Zelle or Money Order.

Legal Compliance and Initial Filing

Upon paying the Initial Filing Fees, the Plaintiff must notarize their portion of the documents online, after which our legal team will verify legal compliance. Before filing the case, a legal compliance verification is conducted. After verifying the legal compliance of the documents, the case is filed electronically with the corresponding court.

Legal Compliance and Final Filing

Upon obtaining the Court Docket Number, the remaining step is to pay the Case Finalization Fee ($295) via Zelle or Money Order, after which the Plaintiff's spouse must sign and notarize the documents online, our legal team confirms legal compliance, and the documents are filed electronically with the court.

Final Decision

Uncontested divorce cases are typically finalized by the judge between 2 and 6 months after the date of the final document filing.

Division of Assets and Debts in New Jersey

New Jersey is an equitable distribution state. This means that assets and debts acquired during the marriage must be divided fairly, though not necessarily in equal shares.

There is an initial presumption of equality, but the court may depart from it based on multiple factors. What is essential is that the agreement between the parties reflects equity and reasonableness.

Not all assets are divided. Separate property – such as those acquired before the marriage, inheritances, or personal gifts – generally remains with its owner.

All assets and debts must be clearly identified and assigned in the divorce documentation.

Minor Children

When there are minor children, the court must establish provisions regarding custody, parenting time, and support.

Custody in New Jersey is divided into two components: legal custody and physical custody. Legal custody refers to the authority to make important decisions about the child's education, health, and well-being. Physical custody determines with which parent the minor primarily resides.

The law presumes that joint custody, especially joint legal custody, is generally most beneficial for the minor, provided both parents act in their best interest.

There is an important exception in cases of domestic violence. The law establishes a presumption against granting custody to any person who has committed acts of violence against the spouse or a minor. If there is credible evidence of abuse or neglect, the court may impose restricted custody and limited visitation.

Child Support
