Divorce by Publication

If you wish to get divorced but do not know where your spouse is located, the law allows, under strict conditions, initiating the process through an alternative notification known as divorce by publication.

This type of case is not a traditional divorce. Before the court authorizes publication in a newspaper or approved medium, you must demonstrate that you conducted a real, documented diligent search to attempt to locate your spouse.

What is a Divorce by Publication?

A divorce by publication is used when:

  • The current whereabouts of the spouse are unknown
  • Personal service/notification is not possible
  • Reasonable location attempts have been unsuccessful

The court will require concrete evidence that you attempted to locate them before authorizing any form of alternative notification. If the spouse does not respond after publication, the case may be finalized through default.

Each state has different rules. That is why our services are structured by specific modules.

Florida Module

In Florida we manage the complete divorce by publication process through structured phases.

The process begins with the public records search, at a cost of $175. A detailed investigation is conducted using available databases to attempt to locate the spouse.

If not located, we proceed with the Diligence Execution phase and preparation of the Affidavit of Diligent Search, at a cost of $225. At this stage, all contact attempts required by law are formally documented.

Once the diligence is completed, the divorce petition and request for publication notification are prepared and filed. The initial preparation and processing has a cost of $250, plus the applicable court filing and publication fees ($624.12, subject to change by the court).

After the legal publication during the required period, the default judgment application is filed. The final phase has a cost of $575.

Once the final package is filed with the court, the case awaits judicial review. We will notify you when the judge issues the decision.

Texas Module

In Texas, our service has a clearly defined scope.

Texas Divorce Online offers complete drafting of the documents necessary to finalize the divorce by default, once you have met the preliminary requirements required by the court.

The cost of the service is $149.

This service includes exclusively the preparation of the document package required to request the final default judgment. It does not include investigation, diligence execution, publication management, payment of court fees, or hearing representation.

In Texas, a court appearance will normally be necessary for the judge to review compliance with the legal requirements before signing the judgment.

Nationwide Module

For customers outside Florida and Texas, we offer a module specialized in diligent search documentation.

This service is divided into two stages.

The first is the Search Report, at a cost of $175, in which we conduct a structured investigation to attempt to locate the spouse and issue a report with the results.

If the spouse is not located, the second stage is the Diligence Execution and preparation of the Affidavit of Search Efforts, at a cost of $295. In this phase, the reasonable location attempts are formally documented and the affidavit is prepared ready for signature.

This module does not include the drafting of the divorce petition or the management of publication or court filing. Its purpose is to provide you with the documentation necessary to demonstrate diligence before the corresponding court.

Important Aspects to Consider

A divorce by publication does not automatically guarantee that the judge will grant all financial requests. If the spouse does not appear, the court may limit certain asset-related decisions.

We also cannot guarantee that the court will authorize publication notification, as that decision depends exclusively on the judge. What we do guarantee is that the documentation prepared will meet professional standards and applicable legal requirements.
