Please read this Terms of Service and Conditions of Use Document in its entirety. This Agreement governs the terms and conditions applicable to the use of this Website and the services it offers, and may be modified at any time. By continuing to use the Website after any modification, you agree to be bound by the new terms. Use of this Website constitutes your acceptance of all terms, conditions, and disclaimers contained herein.

By checking the box "I accept the Terms of Service and Conditions of Use and the Attorney Services Agreement" you affirmatively and unconditionally accept that this Agreement is presented to you in electronic format as displayed at the time of your acceptance, adopting such action as your electronic signature. Your electronic signature has the same legally binding effect as a handwritten signature.

I. PURPOSE OF THE WEBSITE

The purpose of this Website is to provide a platform that allows you and your spouse to complete an uncontested divorce process in a fully virtual and online manner. This Website offers an accessible online divorce service, facilitated by authorized attorneys specializing in uncontested divorces, acting within the scope of the applicable state's current laws.

II. SERVICES OFFERED

The legal services provided through this Website are specifically intended to assist in uncontested divorces (uncontested divorces), in accordance with the current laws of each state. The legal services offered here are suitable only for spouses who have reached an agreement regarding the terms of their divorce. Our online services do not replace the legal advice provided by a duly authorized attorney in situations where there is a conflict between the spouses or a contested trial is anticipated.

The services available on this Website are the following:

  • 1. Uncontested Divorce: Available in Alabama, Florida, Georgia, Maryland, New Jersey, New York, Texas, and Washington. Our legal team prepares all documents necessary for your divorce, which both spouses must review, approve, notarize, and subsequently file with the competent court.
  • 2. Divorce by Publication: Complete service available only in Florida. This service is intended for spouses who cannot locate their partner. The process includes the search for the absent spouse, the execution of location efforts, the preparation of divorce documents, the filing with the court, and the legal publication of the Notice of Action, in accordance with the regulations of the state. In Texas the service includes case review and drafting of the necessary documents.
  • 3. Missing Spouse Nationwide: Available in all states, except Florida and Texas. Includes: obtaining the Search Report, execution of location efforts (Diligence Execution), and preparation of the Affidavit of Diligent Search. This service does not include the (online) notarization, publication or filing of documents with any court.
  • 4. Interpretation/Translation Services: Available in all states. Spanish interpretation during Online Notarization sessions at a cost of $60.00 USD per session.
  • 5. Child Support Modification: Available only in Florida and Texas, exclusively for previous Customers of Divorcio USA, at a flat fee of $395.00 USD.

Legal Services Fee: The Legal Services Fee is charged for the professional services of the attorney assigned to the corresponding state, as described in the Attorney Services Agreement. In general terms, the service fees cover the limited legal advice necessary to prepare divorce documents that reflect the agreements reached between you and your spouse as described in the Interview Questionnaire. Fees vary by state and type of service selected. The Attorney Services Agreement may include additional services, such as online notarization and electronic filing of documents with the court.

Language Notice: All services provided through this Website are rendered entirely in English. Judicial proceedings in the United States of America are conducted in English, and all divorce documents are required by law to be drafted, notarized, and filed in English before the courts. This Website, all outgoing emails, the Interview Questionnaire, the Attorney Services Agreement, and all other service-related communications are made available in Spanish exclusively as a courtesy to facilitate understanding for you and your spouse. These Spanish-language materials are provided for informational purposes only and do not constitute legal documents. In the event of any inconsistency or discrepancy between the Spanish-language materials and the corresponding English-language documents, the English version shall govern and control in all respects. By using this Website, you acknowledge and agree that all divorce documents prepared on your behalf will be drafted, notarized, and filed in English, and that no Spanish-language material provided through this Website alters, supplements, or replaces the English-language legal documents associated with your case.

III. FEES AND PAYMENT STRUCTURE BY STATE

The fees below are expressed in US dollars (USD). An Administrative Fee of $5.00 USD will be applied to each payment made through this Website (see Section IV). Court Fees are set by state and local courts; their amount may vary and is subject to change without prior notice. Divorcio USA does not control the amount of Court Fees and assumes no responsibility for changes thereto.

L. Priority Fee

Important: This fee covers priority queue placement only. It does not guarantee a specific turnaround time, court filing date, court approval, or case outcome.

  • Flat Fee: $25.00

IV. ADMINISTRATIVE FEE

An Administrative Fee of $5.00 USD will be applied to each payment made through this Website, regardless of the amount or payment method. This fee covers the administrative and processing costs associated with the management of your case and is non-refundable under any circumstances.

V. PAYMENT OPTIONS

Credit or Debit Card: The Service Fees and Legal Compliance Fee are paid by credit or debit card through this Website's secure payment platform.

Zelle or Money Order: Court Fees, Court Filing Fees, Publication Fees, and Case Finalization Fees are paid via Zelle or Money Order, as indicated to you by our team. Divorcio USA will verify payment receipt before proceeding with any court filings or legal publications.

Important note: Divorcio USA does not accept cash payments or direct bank transfers (wire transfers). All payments must be made through the methods indicated here.

VI. SERVICE LIMITATIONS

Account Expiration: From the moment your Documents are drafted, your case will be active during the period of 120 days. If you do not make any action within that period, you will need to reactivate your case through payment of the corresponding Reactivation Fee. The information entered in the Interview Questionnaire is voluntarily provided by you and will be deleted from the system upon account expiration. You may request the early deletion of your information by sending a message to info@divorciousa.com.

Document Expiration: Due to the changing nature of legal requirements and court forms, documents prepared by our legal team have a validity guarantee of 30 days from the date you receive them. Failure to file the documents within that period could result in the documents becoming outdated or being rejected by the court due to changes in laws, procedures, or court forms. Divorcio USA shall not be responsible for any consequences arising from the failure to timely file the documents.

Geographic and Competency Scope: The services of this Website are available only for divorces to be filed in the states listed in Section III. Divorcio USA does not offer services for divorces in other states or in international jurisdictions. The documents prepared have been drafted in accordance with the laws of the specific state where the divorce will be filed and will not be applicable in other states or abroad.

Document Language: All legal documents, court forms, and official communications related to your case will be drafted in English, in accordance with the requirements of United States courts. The Interpretation Services and Spanish translations are intended to facilitate the Customer's understanding of the process, but do not alter the language required by the courts.

VII. REFUND POLICY

By providing your payment information and affirmatively accepting these Terms of Service and the Attorney Services Agreement (Attorney Services Agreement / Acuerdo de Servicios del Abogado), you acknowledge and agree to the following refund policy:

First Installment of Service Fee (Refundable Prior to Questionnaire Review):

The first installment of the Service Fee — whether $99.00 (Alabama, Florida, Georgia, Maryland, Texas, Washington) or $149.00 (New Jersey, New York) — is refundable in all cases until your Questionnaire has been reviewed. Questionnaire review constitutes irrevocable confirmation of receipt of the case review service.

Remaining Balance of Service Fee:

The remaining balance of the Service Fee (if paid in two installments) will be non-refundable once you have received your divorce documents. Receipt of the divorce documents means that our legal team spent time drafting them based on the information provided by you, and therefore no refunds of the Service Fee can be made.

Legal Compliance Fee:

The Legal Compliance Fee is non-refundable once an online notarization session has been completed.

Court Fees, Publication Fees, and Finalization Fees:

Court Fees, Publication Fees, and Finalization Fees are absolutely non-refundable once paid, as such funds are transferred directly to the courts and competent agencies.

The following reasons DO NOT constitute a valid basis for requesting a refund of any fees or charges paid:

  1. You and your spouse decide not to divorce.
  2. You and your spouse reconcile.
  3. Death of your spouse.
  4. Change of mind.
  5. You do not meet the requirements to divorce in the selected state.
  6. Problems with your computer equipment, internet connection, or inability to print or access the documents.
  7. Failure to request document adjustments or modifications within the guaranteed 30-day period.
  8. Decision to retain an attorney for independent representation.
  9. Modification of documents prepared by Divorcio USA by the Customer.
  10. Unjustified credit or debit card chargeback claim.
  11. Your divorce becomes a contested divorce.
  12. Your spouse refuses to sign the divorce documents.
  13. Your spouse retains an attorney and contests the divorce.
  14. You provided inaccurate, incomplete, or false information in the Interview Questionnaire or in any communication with our legal team, resulting in documents being drafted based on that information.
  15. You failed to respond to communications from our legal team within a reasonable time, causing delays in or abandonment of the case preparation process.
  16. You failed to complete a required action within the prescribed timeframe, including but not limited to: notarization of documents, signing of agreements, payment of court fees, or review and approval of drafted documents.
  17. Your case was rejected or dismissed by the court due to incorrect, incomplete, or false information provided by you.
  18. You failed to appear at a scheduled court hearing in states where a hearing is required as part of the divorce process.
  19. Any other reason beyond Divorcio USA's control that prevents you from continuing with the divorce process or our services.

Refund Request Process: To request a refund, you must contact our support team by email at info@divorciousa.com or by calling (214) 856-6122. You will be provided with the Unique Refund Form. You must follow the instructions contained in that form to submit a valid refund request. Requests that do not comply with the form's instructions will be automatically denied. Submission of the Unique Refund Form constitutes an official refund request and does not guarantee that your refund will be approved.

Refund Decisions: All refunds will be determined by the case attorney. Generally, refund requests are resolved within three (3) business days from receipt of the duly completed Unique Refund Form. If your refund request is approved, you will receive a Refund Terms Consent Form, through which you must agree to our Refund Terms as a condition of receiving the refund. The approved refund will not be issued until you have submitted the completed Refund Terms Consent Form. Refunds are usually issued within seven (7) to ten (10) business days from receipt of the duly completed Refund Terms Consent Form.

Case Processing Fee: All approved refunds are subject to a non-refundable Case Processing Fee of $35.00 for payments under $100.00, or $50.00 for payments of $100.00 or more. Upon receipt of your payment, your online account is immediately created and activated, and you are granted instant access to the private, restricted Customer area of the Website (the Divorce Portal), which contains the Interview Questionnaire. Your ability to log in to the Divorce Portal using your email address and password constitutes affirmative, unconditional, and irrevocable confirmation that you have received the case setup service.

Refund Method and Time Limit: All approved refunds will be issued exclusively to the original payment method used at the time of purchase. Refund requests must be submitted within 180 days of the original payment date. Requests submitted after this 180-day period has expired will be automatically denied, as our payment processor does not permit refunds beyond that period.

VIII. CHARGEBACK POLICY

If you submit a chargeback to your bank or credit or debit card provider, your case will be automatically suspended until the dispute is resolved. If the chargeback results in the reversal of the payment and you wish to continue with or reactivate your case, you must pay all of the following:

  • The amount of the corresponding Service Fee (paid again in full).
  • A Chargeback Fee of $15.00 USD, charged by our bank.

Misuse of the chargeback procedure, including unfounded or fraudulent disputes, may result in the disclosure of information about your case to your bank, payment processor, or competent authorities for the purpose of challenging the claim, in accordance with applicable payment dispute resolution procedures. Divorcio USA reserves the right to disclose the necessary case information in such circumstances.

IX. SERVICE GUARANTEE

If the local court does not accept the divorce documents at the time of initial filing due to an error made by Divorcio USA in the preparation of those documents, we will correct them at no additional cost, provided those documents were filed within 30 days following the date you received them from our legal team. If it is not possible to correct the error, the Service Fees paid will be refunded, with the exception of the amount corresponding to the non-refundable first installment established in Section VII.

Some local courts may require specific forms that are not available in digital format. In that case, you will need to provide us with the form in the available format so that we can complete it on your behalf, or it may be necessary for you to complete the form directly at the court at the time of filing. The requirement of a specific court form does not entitle you to a refund of the Service Fees.

The Service Guarantee is valid only for 30 days following the date you receive the documents from our legal team. The guarantee does not cover documents modified by the Customer, documents filed outside the 30-day period, or situations beyond Divorcio USA's control.

X. BILLING DISPUTES

This Website is solely responsible for providing the Customer with access information to their Customer area (Divorce Portal) and assumes no responsibility for the subsequent use of that information, its loss, or the inability to access the Portal for reasons beyond Divorcio USA's control. For purposes of any billing dispute, Divorcio USA may demonstrate the access granted to the Customer through: (i) copies of emails containing access information; (ii) records of time and IP address used by the Customer to make their payment and access the restricted pages of the Website; and (iii) the access history to the Customer area and actions taken therein. Notwithstanding the Service Guarantee, you agree that all payments made for Service Fees are final and non-refundable, as established in Section VII.

XI. SPECIAL CIRCUMSTANCES

  1. Change of State: If during your divorce process you or your spouse decide to get divorced in a different state than the original, or the circumstances of your situation require to do so, and you wish for Divorcio USA to prepare the documents for the new state, an additional drafting fee will be charged, as divorce documents, processes, and laws vary from state to state. It will also be necessary to sign a new Attorney Services Agreement and pay the difference of the Service Fee (when applicable).
  2. Petitioner / Respondent Designation Change: If during the process you decide to change the designation of Petitioner and Respondent, a fee of $50.00 USD will be charged for the adjustment of all affected documents.
  3. Revisions Due to Customer Changes: If you need modifications or adjustments to your documents once received, and such changes are not the result of an error by Divorcio USA in the preparation of the documents, you will be charged the revision fee corresponding to the state of your case in accordance with the fee schedule in Section III. Changes that are the result of errors attributable to Divorcio USA will be corrected at no additional cost.
  4. Change to Divorce by Publication: If during the process your spouse proves impossible to locate and it is necessary to initiate a Divorce by Publication process, you will be informed of the additional applicable fees in the corresponding state.
  5. State Court Fees: Any fee or cost associated with Filing Fees — including, among others, court filing and publication fees — are the exclusive responsibility of the Customer and are separate from the Service Fees. Court and Publication Fees are paid directly to the court if the Customer opts for independent filing, or through Divorcio USA if the filing service is contracted.

XII. MILITARY DIVORCE

In cases where one or both spouses are on active military service at the time of the divorce, it will be necessary to sign a waiver of the Servicemembers Civil Relief Act. Both parties must agree to the divorce and be willing to sign all documents requiring their signature. At least one of the spouses must be in the United States or be willing to travel to the corresponding county court to complete the process. You or your spouse must meet the residency requirements of the state and county where you wish to file the divorce.

XIII. PROHIBITED USE

As a condition of using this Website, you agree not to use this Website for any purpose that is illegal or prohibited by these Terms of Service and Conditions of Use. All information you provide to this Website or to the case attorney through the Interview Questionnaire or by email must be truthful, accurate, and not falsified. You declare that you are using this Website and the documents under your real name and not under a fictitious name, and that you intend to use the documents for the purpose for which they were prepared. You shall not use the documents for any purpose other than that intended.

Your right to use the Website and the documents is non-transferable. The access codes and passwords provided by this Website are for your exclusive use and must not be shared with third parties. This Website contains hyperlinks to websites operated by third parties; such hyperlinks are provided for reference only and Divorcio USA assumes no responsibility for the content of those third-party websites.

XIV. PRIVACY POLICY

Your privacy is important to us. We use your personal data only to provide you with the contracted services and to inform you of new features, services, and products offered by us or selected third parties. If you wish to stop receiving such communications, you may opt out by contacting us directly at info@divorciousa.com or by contacting the corresponding third party.

Except as provided in the Website Privacy Policy, we will not provide any personally identifiable data to third parties without your consent, except when, at the reasonable discretion of Divorcio USA, disclosure is necessary to comply with any law, regulation, court order, subpoena, investigation request, discovery request, or other legal requirement, including responding to credit card disputes or chargebacks. You agree that Divorcio USA, the case attorney, and their payment processor may disclose personal data without prior notice in the aforementioned cases, and that Divorcio USA will make reasonable efforts to protect your information in such circumstances. You agree that Divorcio USA shall not be liable to you for any inadvertent disclosure or unauthorized access by third parties to your personal data.

By providing your phone number, you consent to receiving text (SMS) communications from Divorcio USA related to your account, service updates, or other relevant communications. Message frequency may vary. Message and data rates from your mobile carrier may apply. To stop receiving messages, reply STOP. For help, reply HELP. XV. COPYRIGHT AND TRADEMARKS

This Website is protected by the Copyright Laws of the United States of America. All content on this Website is the exclusive property of its owners. No copyrighted work may be copied, reproduced, distributed, or publicly displayed without the consent of the author or copyright holder. Any unauthorized use of this Website or any of its contents, in whole or in part, will constitute copyright infringement.

In the event of infringement, the rights holder may seek injunctive relief, seizure and disposal of infringing materials, attorney's fees, actual damages and any economic benefit obtained as a result of the infringement, or statutory damages of up to $150,000.00 USD if the infringement was committed willfully.

No part of this Website may be reproduced in any form, whether electronic or otherwise, without the prior consent of Divorcio USA, except temporarily in the course of normal service use or to keep a record of a transaction conducted through it. Company names mentioned on the Website may be trademarks of their respective owners. All rights not expressly granted in this Agreement are reserved.

XVI. DOCUMENTS

The divorce documents prepared by our legal team will contain the information you provided through the Interview Questionnaire. However, there may be sensitive information that you prefer to add directly to the documents, such as Social Security Numbers, financial data, or other confidential information. If you decide not to provide certain information to Divorcio USA, you assume exclusive responsibility for adding that information to the documents before they are filed with the court. Omission of required information could result in the rejection of your case by the court.

Divorcio USA will prepare the documents based solely on the information you provide. You are responsible for the truthfulness and accuracy of all information provided to our legal team.

XVII. DISCLAIMERS — IMPORTANT NOTICE

PLEASE READ THE FOLLOWING NOTICE CAREFULLY, AS IT AFFECTS YOUR RIGHTS.

IF YOU USE ANY DOCUMENT OR SERVICE FROM THIS WEBSITE, YOU WILL DO SO UNDER THE TERMS SET FORTH IN THIS DISCLAIMER. THE DOCUMENTS AVAILABLE ON THIS WEBSITE HAVE BEEN PREPARED BY LICENSED ATTORNEYS. ALTHOUGH DIVORCIO USA HAS EMPLOYED REASONABLE CARE IN THE PREPARATION OF SUCH DOCUMENTS, IN MOST CASES THEY WILL NEED TO BE ADAPTED TO THE PARTICULAR CIRCUMSTANCES OF EACH CUSTOMER.
